Rental Policy

In consideration of the rent received and the mutual promises contained herein, Owner of the Rental Property does hereby lease and rent to Guest(s) such Rental Property under the following terms and conditions. Guest agrees to abide by all rules and regulations contained herein or posted on the premises related to the Rental Property.  Guests obligations include but are not limited to keeping the premises as clean and safe as the conditions of the premises permit and causing no unsafe or unsanitary conditions in the common area and remainder of the premises that Guest uses.  Guests agree not to use the premises for any commercial activities or purpose that violates any criminal law or governmental regulation.  Guest's breach of any duty contained in this paragraph shall be considered material and shall result in the termination of guest occupancy with no refund of any kind. In no event shall the Rental Property be occupied by more persons than the capacity of the property as stated on the web site or the confirmation letter.  Any persons found over the max capacity of the Rental Property will be removed from the property and damage deposit and rent will be forfeited. No fraternities, school, civic, or other non-family groups are allowed unless Owner grants prior approval.  In no event shall Guests assign or sublet the Rental Property in whole or in part.  Violations of these rules are grounds for expedited eviction with no refund of any kind.

 

      Guests hereby acknowledge and grant specific permission to Owner to enter premises at any time for inspection purposes should Owner reasonably believe that Guests are causing or have caused any damage to Rental Property.  Guest further agrees to grant Owner access to Rental Property for purposes of maintenance and repair.

 

SECURITY DEPOSIT HOLD:

A security deposit hold is required prior to arrival in the amount of $400 and will be automatically released 5 days after checkout unless there are damages or excessive cleaning fees, at which time, damage amounts or excessive cleaning fees will be charged up to the full amount of $400 depending on cost of damages. A security deposit hold is just a pending transaction on your credit card that will not be processed unless damages are found, at which time, the hold will be changed to a processed transaction in the amount of the damages. The security deposit hold will be placed three days before your check in date on the credit card that was provided during the booking process.  If for any reason the hold fails on your credit card you will be asked to provide a new credit card before the door code is released to you for check in. The door code will not be released for guest until a successful security deposit hold is in place.

The following provisions must be met to to have the security deposit hold released:

-No damage is done to the property or its contents beyond normal wear and tear, and no contents are missing.  If there is damage or missing items noticed upon arrival they must be reported immediately.

-Linens are left in good condition and none are missing.

-Dishes, glassware, cookware, utensils, etc are either washed and put away in cabinets or placed in the dishwasher and the dishwasher started.

-No occupancy greater than 12 people to include children and infants 0 and up.

-There is no smoking (that includes non-tobacco substances) or evidence of smoking inside the rental and cigarette butts are properly disposed of in the receptacles located on each deck. Evidence of smoking inside the rental will result in forfeiture of the entire damage deposit.

-Property is left in a clean, neat condition and all furniture placed in its original location. Yard area is left clean and neat with all trash put in the designated bear-proof containers outside.

-Nothing is missing from the property and premises, to include furniture, decorations, electronics, gaming devices, games, appliances or any other property listed as inventory in the listing and website photos.

 

PAYMENTS:

If the booking is made more than 30 days in advance of the arrival date, 50% of the total is due at the time of the booking.  Any and all remaining balance must be paid in full 30 days prior to the arrival date, or this Agreement may be cancelled by the sole option of the Owner. An automatic credit card payment for the remaining balance will be scheduled by the Owner to be made 30 days prior to the arrival date.  The credit card of the first payment is used if a credit card was provided.  If the automatic payment fails for any reason, it is the responsibility of the Guest to make sure that the remaining balance is promptly paid in full, or the reservation will be canceled with no refund of payments made.  All policies contained in this Agreement shall apply equally to payments made by credit card, check or cash and whether made via website, by phone or in person. Any refunds due to Guests from a credit card payment will be refunded by credit card transaction; all other refunds will be made within 30 days by check. If the arrival date is less than 30 days from the date you are making the reservation, the entire amount is due when reservation is made.

 

Cancellations

-In the event Guests wishes to terminate this agreement, one hundred percent (100%) of the rental amount will be refunded if the cancellation is made 60 days or more prior to the check in date of the reservation. If the cancellation is made between 31 and 59 days prior to check in date, the rental amount will be refunded at fifty percent (50%). Anything 30 days or less before check in date, no refund will be issued. All cancellations will be subject to a 3% processing fee.

 

ACTS OF GOD, WEATHER, ROAD CONDITIONS, ETC: No refunds will be provided due to no shows, shortened stays because of late arrivals or early departures, inoperable appliances, pools, hot tubs, etc.  The Owner will make every reasonable effort to assure that such appliances will be and remain in good working order. We highly recommend renters purchase travel insurance as NO refunds will be given due to power blackouts, water shortage, flooding, snow, construction at adjacent properties, job loss, injury/illness, weather or mandatory evacuations of the area by county officials due to potentially dangerous situations arising from acts of god or nature. 

 

PETS:

Pets are not permitted. Any evidence of pet(s) found in or about the Rental Property will be grounds for expedited eviction and forfeiture of all monies paid to include damage deposit. Renter will be billed for any costs associated with the required cleaning and repairs above and beyond the damage deposit.

 

CHILDREN:

Guests must inform the Owner of their intention to bring children and the specific number.  A child is defined as any person under the age of 18.

 

CHECK-IN/CHECK OUT:

Check-in time is no earlier than 4pm eastern time. Check-out time is no later than 10 am eastern time. Please do not arrive early or depart late as this will adversely affect the ability of our housekeeping staff to prepare the premises for occupancy. If you do not vacate the property by the stated check-out time, you will be charged $50 for each additional 30 minutes you occupy the property, up to the amount of one night’s stay. Early check-in or late check-out may be available in some cases by advance arrangements with the owners.

 

NON-SMOKING RENTAL:

Smoking is NOT permitted inside the cabin, this includes non-tobacco substances, however guest may smoke outside on the decks and are asked to properly dispose of the cigarette butts in the provided receptacles on each deck. If evidence or odor of cigarette smoke is discovered inside the property after your rental, you will forfeit your entire damage deposit and will be billed for any costs associated with odor removal above and beyond the damage deposit.

 

ACCOMDATIONS & FURNISHINGS:

This property is privately owned and furnished by owners according to their taste. The kitchen comes stocked with adequate cookware and dinnerware. Beds have mattress covers, sheets, bedspreads, and pillows. You will need to bring all supplies and personal items not specifically mentioned in this agreement. No refunds will be given for missing cabin items or cabin amenity inadequancies; however, every effort will be made to replace the missing items or to resolve any cabin deficiencies/damages.

 

CONDITION OF PROPERTY:

When you arrive, the property should be clean and ready for your stay with the following: linens for all beds and pull out sofas, blankets, pillows, bath towels, hand towels, washcloths, kitchen dishtowels. Approximately 2 rolls of toilet paper per bathroom, 1 roll of paper towels, a starter set of dishwasher detergent, dish soap and trash can liners.  This are only meant to get your stay started.  You will need to purchase what is needed for your entire stay. The gas fireplace will be operational October 1st through April 10th. If the cabin is not clean upon your arrival, please contact the owners immediately. Will we do our very best to correct the situation. We provide arcade games, pool table, Xbox, Ruko devices and Xfinity service. Please do no tamper with smoke detectors, carbon monixode detectors or fire extinguishers. Immediately report any issues that are noticed with these fire prevention devices.

 

TELEPHONE & WIFI:

A landline phone is in the Rental Property for your use during your stay and may be blocked from making international calls. Complimentary WiFi is provided for your convenience. Log in instructions will be provided in your check-in procedures that will be sent out closer to your stay via email.

 

REPAIRS:

We take pride in maintaining our cabin and perform regular maintenance to keep everything in good working order. It is possible, however, to guarantee that all appliances, hot tubs, fireplace, etc. will be in working condition 100% of the time. We will, however, make every effort to correct any problem you may encounter during your stay as soon as possible. Non-emergency maintenance issues will be handled during normal business hours. If maintenance is required, please contact the owners first at (931)249-2858 or (931) 302-2080. While we will attempt to correct all issues as quickly as possible, no refunds will be made for mechanical failures of hot tub, appliances/electronics, or interruption/loss of utilities (including TV, phone, power or WiFi).

 

PERSONAL BELONGINGS:

Guest is responsible for all shipping costs for any Lost and Found items that Owner is requested to return to Guest.  Items found and not claimed within 30 days will be disposed of at the discretion of Owner. Owners and our insurance company are not liable in any way for damage, loss, or theft of items you bring to the property. This includes, but is not limited to, items damaged by electrical surges or lightning, burgulary when you are at or away from the property, or items left accidentally after your stay is complete.

 

HOT TUB:

The hot tub provided at the Rental Property will be prepared/cleaned and tested for proper and safe chemicals prior to or on the day of occupancy. Prior to unlocking or using the hot tub, guests must completely review and understand the hot tub operating procedures which is located in the welcome book. Guests must follow all rules that are posted outside the hot tub and listed below:

      -Guests must shower before entering the hot tub.

      -If you have any medical conditions, such as heart disease, low or high blood pressure, circulatory system problems, diabetes, obesity, etc. or are taking any type of drugs please consult a physician before using the hot tub. Persons that have skin sensitivities or open wounds should not use the hot tub.

      -Do not use any type of soaps, shampoo, lotions, bubbles or bath oils in the hot tub, as damage to the hot tub or skin irritation may occur. If evidence of use of shampoo, bubbles, lotions, bath oils or other substances is found, your damage deposit will be forfeited. Do not take any products or items into or around the hot tub, including glass, which may clog the filter, damage the hot tub, endanger persons, cause injury or skin irritation. Do no submerge your head, ingest water, or allow the water to contact your eyes.

      -Minors must be supervised by an adult.

      -Cover must be placed back on hot tub and locked when not in use or not supervised. Please do not sit, stand, climb or lean on hot tub cover.  Any damaged done to the hot tub cover will be taken from the damage deposit.

 

CHECK-OUT PROCEDURES:

Prior to check-out all dishes are to be washed and put away in cabinets or put in dishwasher and then start the dishwasher. Do not strip beds (i.e, please leave beds unmade with sheets and pillow cases left on. This is for the convenience of our guests and allows housekeeping to easily determine if all linens are present prior to laundering). Towels from all bathroom need to be collected and placed in the bath tub on the main floor. Place all trash in the outdoor bear-proof receptacle and make sure this receptacle is locked at all times. Please make sure all trash is bagged before placing in the receptacle. Turn off all lights and appliances. Close and lock all windows.

 

GAS FIREPLACE & OUTSIDE GAS GRILL:

The property has one gas fireplace located on the main floor and will be operational from October 1st through April 10th. The fireplace works off a timer located to the upper right of the fireplace. Minors are prohibited from operating the fireplace. Do not tamper with any valves or controls related to the fireplace or propane tank. There is also an electronic fireplace in the upstairs bedroom.  This fireplace is for cosmetic use only and does not give off any heat.  It also works off a time located on the fireplace.  The gas grill is located on the main floor deck and must be operated and closely monitored by a capable adult. Minors must be monitoried closely when around the fireplace or grill to avoid injury.

 

MINIMUM AGE AND MAXIMUM OCCUPANCY:

You must be 25 years or older to rent this property, and provide a copy of a valid government-issued photo ID within 48 hours of booking. You agree and affirm that the property is to be occupied by {number} adults and {number} of children (ages 0 and up), not to exceed 12 persons at any time during your stay, whether inside the dwelling and/or on the property grounds. Guest signing this agreement must physically occupy the property during the entire rental period. At no time should minors (under the age of 18) be left at the property with the Guest present. Any reservations obtained under false pretense will be deemed to be canceled by you; you or the member of your party will not be permitted to check in, and if already checked in, may be required to vacate the property immediately. Violation of these terms will result in immediate termination of stay, and forfeiture of your deposit and rent.

 

SHORT TERM RENTAL (NOT A LEASE):

Guest expressly acknowledge and agrees that this agreement is for transient occupancy of the property, and that Guest does not intend to make the property a residence or household, and Guest has no rights to renewal or for recurring usage. Guest shall not sublet the property in whole or part.

 

HOUSE PARTIES/EVENTS:

House parties and events are strictly prohibited and are grounds for immediate eviction and forfeiture of deposit and rent. No fraternities, school, civic, or other groups are allowed.

 

SECURITY DEVICES: Owners reserve the right to install and operate security devices or image capture/image recording devices anywhere on the property outside the dwelling for the express purpose of securing property, driveway, entryway, parking, and the dwelling.

 

ADDITIONAL TERMS & CONDITIONS:

      -Any modifications to the terms and conditions above must be approved in advance by owner.

      -Rates, terms & conditions are subject to change without notice.

      -Guest assures the owner that the guest will observe all conditions and terms of this lease as to maintaining the property in good order and appearance and will conduct themselves in a manner inoffensive to neighbors. Offensives conduct could include, but is not limited to, the use of vulgar language, playing loud music, reckless driving/speeding or rude/sexual behavior which can be heard or seen by neighbors. If the guests or guest’s guests choose to be outside after 11pm eastern, noise and talking must be kept to a low level so that it cannot be heard by the neighboring residents. If complaints are received from neighbors concerning violations of this paragraph, guest will be immediately denied continued occupancy and will forfeit their deposit and rent.

      -Guest agrees that any guest (or their guest) who is found using (or allowing others to use) drugs, fireworks, or firearms (including BB or Airsoft type guns) on the property will be immediately denied continued occupancy and will forfeit their deposit and rent.

      -NO illegal activities by guest, guest’s party or anyone admitted by guest(s) are allowed on the property, whether inside the property or on the grounds or adjoining public right aways. Guest will be fully responsible and liable for any illegal activity.

      In the event Owner is unable to make Rental Property available for any reason other than described above, guest agrees that Owner's sole liability as a result of this unavailability is to provide a full refund of all monies paid under this Agreement and Guest expressly acknowledges that in no event shall Owner be held liable for any special or consequential damages which result from this unavailability.  Guest also agrees to indemnify Owner from and against liability for injury to Guest or any other person occupying Rental Property resulting from any cause whatsoever including, but not limited to, injury sustained as a result of use of the phone, hot tub, whirlpool tub, electronics, gaming systems, etc. except only such a personal injury caused by the gross negligence or intentional acts of the Owner.

Owner may terminate this Agreement upon the breach of any of the terms hereof by Guest.  Guest shall not be entitled to the return of any rental monies paid under the terms of this Agreement and shall vacate the Property immediately.

      Agreement shall be enforced under the laws of the state within which the Rental Property is located, including any applicable rental acts of that state, and represents the entire Agreement.  Any amendments must be in writing and signed by both parties.  In the event of a dispute, legal action may only be instituted in the county within which the Rental Property is located.  If any part of this Agreement shall be deemed unenforceable by law, that part shall be omitted from this Agreement without affecting the remaining Agreement.  Owner shall conduct all brokerage activities in regard to this Agreement without respect to the race, color, religion, sex, national origin, handicap, or familial status of any Guest.

      The Rental Property may offer access to recreational and water activities, including but not limited to canoes, bicycles, and swimming.  Guest fully understands and acknowledges that outdoor recreational and water activities have inherent risks, dangers and hazards.  Participation in such activities and/or use of equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability.  Guest agrees to fully indemnify and hold harmless the Owner and any and all agents, employees, or contractors for any injury or damage caused by these activities, whether caused by the negligence of the Owners, the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes foreseeable or unforeseeable.  Guest hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the Owners or by any other person.  Guest hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Owner and any and all agents, employees, or contractors from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of Rental Property facilities, equipment, or activities.  Guest further assumes full responsibility for the actions of any and all persons whom he may allow to enter the property during the rental period and indemnifies Owner from any and all claims arising from such other persons.
